Choosing David as your buyer’s agent means that our team is working with your best interests in mind. This relationship applies to property listings held outside the Farchette & Hanley brokerage. You, as the buyer, agree that while discussing, viewing, researching and engaging us in your pursuit of real estate to purchase, trade or lease, you acknowledge that we represent you as your agent. Any and all confidential information relating to you shall be held in strict confidence and that we are acting in the capacity of a “Buyer’s Agent or Buyer’s Broker”.
In the event that you and I discuss, view, research or make and/or negotiate an Offer to Purchase for a property that is currently listed with Farchette & Hanley Real Estate, our team and Farchette & Hanley Brokerage become disclosed dual agents. As dual agents, our team and Farchette & Hanley Brokerage represent two clients whose interest are, or at times could be, different or adverse. For this reason, our team may not be able to advocate on your behalf to the same extent that we may have if we represented only one client.
Whether working for you as a buyer’s agent or a disclosed dual agent, the following tenets shall apply:
- Treat all clients honestly.
- Disclose latent (not readily observable) material defects to the buyer, if known by the agent(s) or brokerage.
- Provide information regarding lenders, inspectors and other professionals, if requested.
- Provide market information available from a property listing service such as MLS, if requested.
- Prepare and present all offers and counteroffers at the direction of the parties.
- Assist both parties in completing the steps necessary to fulfill the terms of any contract, if requested.
In most circumstances the seller/owner is agreeable to compensating a buyer’s agent. However, there may be instances when this is not the case; for example, a for sale by owner property or “FSBO”, or in the event that the seller/owner of a property that is listed with another agency refuses to compensate a buyer’s agent. If this circumstance arises, the buyer(s) would agree to pay the agent’s commission in an amount to be agreed to by the buyer(s) and Farchette & Hanley Real Estate, prior to submission of an Offer to Purchase Agreement to the seller/owner of the property. The agent shall always first seek compensation from the seller/owner, or seller/owner’s agent. Under most circumstances, a seller and listing broker are happy to compensate the buyer’s agent as the objective is to sell the property!
